Item Open Access Community Bonding: Rebuilding Duke University and Durham, North Carolina to Promote Sexual Autonomy(2019-12-19) Sara, StevensMy central question asks how universities can engage with local communities to work towards increased sexual safety on campuses. Specifically, I first argue that universities can improve sexual safety on campuses by incorporating ideas about consent and sexuality from alternative sexual communities into safety initiatives. I then argue that universities can further improve sexual safety on campuses through engagement with off-campus business that are central to student life. Student activists and university administrators must reach outside the university to engage with local communities and unite against all forms of sexual misconduct. I cast a wide net in Chapter One to look at the various notions of safety, consent, and gender in contemporary BDSM (bondage, discipline (or domination), sadism (or submission), and masochism) communities in hopes of finding new ways to restructure modes of though around sexual assault and harassment prevention. I find that the normative response from Duke University (and their peer institutions) against sexual assault and harassment prevention to add more policy and review boards is not working. Chapter two brings readers back to the relationship between Duke and Durham to evaluate how restructuring sex education and community engagement can form a better response against sexual misconduct and improve sexual justice at its core. My research led me to realize how important sexual autonomy is to community health. As it currently stands in the United States, policies, laws and ideologies around appropriate sexual conduct damage sexual autonomy. Our autonomy forms how we interact with our outside community, not just intimately but socially. Therefore, if Duke University wants to strengthen sexual justice on campus, they need to first invest in sex education to re-build students’ sexual autonomy.Item Open Access Fictions of Consent: Contract and the Victorian Novel(2022) Davenport, EmmaThis project addresses how democratic regimes founded on ideals of individual agency and personal freedom systematically disadvantage groups and persons. I argue that (neo-)liberalism enacts this inequity not incidentally, but by design, creating an illusion of free choice and consensual contract while actively obscuring the coercive mechanisms that sustain inequality. As the era in which contractual agency was consolidated into a national political program, the Victorian period produced a plethora of legal and literary justifications for the injustices sanctioned by English liberalism. I aim to reveal the contradictions internal to these justifications, while also disclosing methodologies of resistance. Today, we remain Victorian in our reliance on a model of individual consent to rationalize our political system; my interest in Victorian novels lies in their ability to reimagine and critique the political conditions that we take for granted today.
"Fictions of Consent" starts with a puzzle: there are certain kinds of criminal behavior—murder, sexual deviance, cannibalism—that are exceptional rather than typical, yet nevertheless generated enormous concern in Victorian jurisprudence and popular culture. I contend that nineteenth-century law and literature seem to have allocated undue attention to exceptional crimes not because of their sensationalism per se—not because they’re extraordinary—but because they’re actually dangerously ordinary. There are behaviors, I argue, that the law is invested in expelling as criminal, but that the novel can help us see as contractual. When novelists translated outlandish criminal behavior into rational attempts of modern subjects to negotiate consensual relationships with one another, they transformed these ostensible anomalies into the predictable culmination of a liberal social order: these crimes now became part and parcel of a society based on freedom of contract. Novelists including George Eliot, Charles Dickens, Robert Louis Stevenson, Mona Caird, and Thomas Hardy suggest that the violent coercion apparently unique to the extreme situation in fact represents the ordinary logic of liberalism.
Item Open Access Student Knowledge and Understanding of Sexual Violence: A Case Study at Duke University(2016-01-07) Becker, EricaAn estimated 20-25% of women experience sexual assault while at college. In response, institutions of higher education are improving their policies and working to educate students on the issue. The purpose of this study is to examine whether undergraduate students at Duke University know and understand the University’s Student Sexual Misconduct Policy on consent and sexual violence. Data gathered from student surveys (n = 320) yielded mixed results on respondents’ knowledge of the policy. In addition, though students had greater understanding of sexual violence than hypothesized, respondents lacked understanding of the role of alcohol in consent. Statistical analyses showed that men, varsity athletes, freshmen and non-LGBTQ students were more likely to misunderstand sexual violence, as measured through responses to scenario questions on the student survey. Recommendations of this study to the University include adding information on alcohol and consent to the Student Sexual Misconduct Policy, improving outreach and follow up for educational programming, and implementing scenario questions in future surveys and training materials.
