DukeSpace Open Access Deposit License

For Duke faculty authors of scholarly articles created since March 2010, the ability to make these articles open access is enabled by the license granted under the Policy on Open Access to Research, which can be found in Section 6.4 of the Duke University Research Policy Manual. https://policies.provost.duke.edu/docs/chapter-6-innovation-and-intellectual-property#64-policy-on-open-access-to-research

This license allows the University to archive, reproduce, and provide open access to scholarly articles authored by Duke faculty. This deposit license is simply a reminder of the existing license already granted under the Policy on Open Access to Research, and your deposit confirms your intention for Duke to make the deposited work openly available.

For Duke authors not covered by the open access policy, such as students or staff, and for works not covered by the policy, such as scholarly monographs, by uploading a copy of your work here you agree to grant Duke a license similar to that granted in the open access policy: you hereby grant Duke a nonexclusive, irrevocable, royalty-free, worldwide license to exercise any and all rights under copyright, in any medium, relating to the publication being deposited, and to authorize others to do so, provided that the work is not sold by Duke or those that Duke authorizes under this license.

In both of the above cases you also represent that you have the right to grant this license to Duke University and that your submission does not, to the best of your knowledge, infringe upon any third-party's copyright. If the submission contains material for which you do not hold copyright, you represent that you have obtained the unrestricted permission of the copyright holder to grant this license to Duke University, and that such third-party material is clearly identified and acknowledged within the text or content of the submission. In the event of a subsequent dispute over the copyrights to material contained in this submission, you agree to indemnify and hold harmless Duke University and its employees or agents for any uses of the material authorized by this license.

Materials deposited under this license will be made available to the public by Duke University under a Creative Commons Attribution-NonCommercial license. (CC-BY-NC).
